Position description
The Law Society of Saskatchewan is looking for a permanent full-time Legal Counsel to join our team. The position would have shared responsibilities in the areas of Professional Responsibility and Regulation. Reporting to the Director of Regulation and Director of Professional Responsibility, this position supports the organization's professional responsibility and public protection mandate by providing guidance and assistance respecting professional responsibility, ethics, and regulatory and compliance matters, and by supporting the Law Society's General Counsel in prosecutions of members and in unauthorized practice matters.

Roles and responsibilities
The Legal Counsel position would have shared responsibilities as Professional Responsibility Counsel and Regulation Counsel. The division of responsibilities will vary at times and will initially focus on the Professional Responsibility Counsel responsibilities.

Professional Responsibility Counsel responsibilities include:
o  Review and investigate written complaints against legal professionals, providing analysis and recommending appropriate action
o  Respond to inquiries from members, the public and other Law Societies regarding legal ethics issues, including the analysis of the facts, application of the Code of Professional Conduct and/or relevant Rules of the Law Society of Saskatchewan, and the provision of advice and options to members
o  Conduct research and prepare memoranda on ethics and conduct issues
o  Identify trends and areas for consideration with regard to the Model Code of Conduct and the Code of Professional Conduct
o  Conduct research and prepare opinions, recommendations, and memoranda in relation to regulatory and compliance matters
o  Provide drafting assistance with regard to amendments to the The Legal Profession Act, 1990, Law Society of Saskatchewan Rules, and the Code of Professional Conduct

Regulation Counsel responsibilities include:
o  Review and investigate allegations of the unauthorized practice of law, providing analysis and recommending appropriate action
o  Respond to inquiries from members and the public regarding matters related to the unauthorized practice of law and firm regulation
o  Prepare necessary court applications and materials to proceed with Injunctions against unauthorized practitioners.
o  Support delivery and development of firm regulation programs and initiatives currently including: the New Sole Small Firm Practice Program, the online Practice Management Assessment Tool, and Trust Safety initiatives
o  Provide back up support to the General Counsel as Hearing Counsel for disciplinary and Admissions and Education matters

Other responsibilities include:
o  Conducting research and analysis of legal and policy issues
o  Develop and implement initiatives supporting the Law Society's strategic goals in the areas of responsibility
o  Preparing documentation and materials for, and providing support to Law Society Committees
o  Participating in relevant national committees and working groups

Key competencies and assessment criteria
Qualifications
Successful applicants will possess the following qualifications:
  • Member of the Law Society of Saskatchewan or eligible to become a member of the Law Society of Saskatchewan
  • Minimum of 5 years current experience in the practice of law
  • Proven research, analysis and writing skills
  • Ability to analyze situations, discern issues and communicate professionally and empathetically
  • Excellent written and verbal communication skills
  • Technological proficiency, especially in the use of electronic forms of communication
  • Ability to work effectively in a team-based environment
Lived experience as a member of an equity-seeking/equity-deserving group will also be considered an asset.
